Backyard Rental Units or
Accessory Dwelling Units (ADUs)

The Flathead County Planning Board has proposed adding ADUs to many zoning districts in the county.  On Dec. 9, 2014 the Flathead County Commissioners will make a final decision on this proposal. Please take time now to email your comments to the County Commissioners at enelson@flathead.mt.gov

Citizens for a Better Flathead recognizes the important role that Accessory Dwelling Units can play in addressing the evolving housing needs in a community if the standards for, and location of, such housing units are carefully drafted to provide safeguards for the property rights and expectations of those who have invested in homes and property based on the existing zoning and neighborhood character of the area.

As proposed, however, the simple addition of ADUs to most zoning districts is lacking in the definitions, standards, criteria for review, and measurable goals, needed to provide the safeguards that property owners have a right to expect. As proposed this new zone can easily degrade the character, stability, and appropriate density of development in currently zoned areas that would be impacted directly by this zoning text amendment. For this reason, and for the more detailed reasoning included in our comments to the commissioners and our recent email alert, both available with links on the right side of this page, we encourage the Commissioners to send this proposal back to the planning board for additional review and consideration of the merit of incorporating many needed safeguards and changes.

October 21, 2009: Flathead County is proposing a new zoning district classification, named Large-Tract-Rural (L-T-R). It would be incorporated into the zoning regulations as Section 3.44. The new use district is intended to protect continued traditional natural resource based uses in rural locations, maintain public access for outdoor recreational uses while providing development flexibility for landowners in remote rural areas. This proposal is very new and is raising significant questions for us about its potential impact in rural areas.  Watch this site for additional comments from CBF on this proposal soon. An open house/ Q&A on this new zone is scheduled for Monday, October 19th, at 6:30pm at the county planning office in the Earl Bennett Bldg.  A hearing on this zone is scheduled for Wed. October 21st at the Earl Bennett Bldg, 2nd floor conference room.
